How to Register a Holiday Let in Andalucia in 2026

Quick answer

The national NRUA registration number created by Real Decreto 1312/2024 has been annulled after STS 620/2026, reported on 21 May 2026. That does not abolish holiday-let registration in Andalucia. If you advertise a tourist let on the Costa del Sol, the live route is still the Junta de Andalucia’s Registro de Turismo de Andalucia, now using the VUT code format, for example VUT/MA/00000 in Malaga province. The old VFT/MA/00000 language is still common, but the Junta’s current FAQ uses VUT.

Last checked: 8 June 2026. This is a live-regulation guide. The Junta’s new Ley de Turismo Sostenible was still not verified as enacted in BOJA when this page was checked. The sanction ladder below is therefore treated as a finalising project-law risk, while the existing RTA registration duties and PIPA 2026 inspection plan are already live.

The 2026 state of play

The bad headline is easy to misunderstand. Spain’s Supreme Court, in STS 620/2026, has annulled the national Registro Unico de Arrendamientos procedure created by Real Decreto 1312/2024. That national layer was the source of the NRUA and the annual national declaration anxiety. The better reading is narrower: the state register was annulled because it sat on top of autonomous-community tourism registers. Post-ruling reporting from EFE and idealista says the Supreme Court left the Ventanilla Unica Digital, platform data-sharing and statistical-data provisions standing. In plain English: the national code fell; the regional tourist-registration regime did not.

What you actually need now: the RTA / VUT

For a holiday let in Andalucia, the working registration is still with the Registro de Turismo de Andalucia, usually shortened to RTA. The Junta’s current Viviendas de uso turistico page links the live online forms for starting activity, changing data, ceasing activity and submitting documents.

The important terminology change is this: older owners, portals and advisers still talk about VFT, especially VFT/MA/00000 in Malaga province. The Junta’s current FAQ now describes the inscription code as VUT/HU/00000 in its example, with the province letters changing by province. For Malaga, that means VUT/MA/00000. If your property was already registered under VFT language, the practical job is not to invent a new licence. It is to confirm the current RTA entry and update the code shown in your listings if the Junta record has moved to VUT wording.

Documents checklist

The old owner shorthand was usually “title deed, NIE, cadastral reference, occupancy licence, floor plan.” That is still useful as a preparation file, but it is not the same as the Junta’s current extra-document list. The current Junta FAQ says the declaration itself is the starting obligation, and that the following documents should be attached to speed later checks because the administration can request them after the registration resolution:

  • Updated nota simple from the Property Registry. This is the cleanest proof of ownership and registered property details.
  • Community approval certificate. The Junta FAQ asks for a certificate from the community secretary or administrator confirming express, current approval for tourist use.
  • Exploitation title if the operator is not the owner. For example, a management, cession, exploitation or similar agreement showing who is entitled to operate the whole dwelling.
  • Representation document. Needed if someone files on behalf of the owner, unless a qualifying representative digital certificate is being used.
  • Empadronamiento certificate for room-by-room tourist lets. Relevant where the property is registered in the per-room group.
  • Co-ownership annex. Needed if there is more than one owner and the owner is the operator.
  • Joint-representation annex. Relevant where representatives sign jointly.

For your own working file, also keep the escritura or purchase title, cadastral reference, DNI/NIE, municipal occupancy or use paperwork if applicable, a basic floor plan, energy certificate, insurance details, community statutes and any town-hall planning note. The Junta may not list every one of those as a required upload at the first step, but they are the papers that usually decide whether the file survives a later inspection, community challenge or platform compliance request.

The 10-working-day trap: the Junta FAQ says that if later-requested extra documents are not provided within 10 working days, cancellation proceedings can begin. That is the part many owners miss because the online filing can feel “done” before the file has actually survived verification.

Displaying the code

The regional code has to appear in your advertising. The Junta FAQ says the registration code must be indicated in all advertising or promotion, including online platforms. That means Airbnb, Booking, Vrbo, property-management sites, agency pages and your own booking page.

The national NRUA code is different. Before the Supreme Court ruling, RD 1312/2024 required platforms to collect and display the national number. After STS 620/2026, current reporting says the NRUA obligation created by the state register has fallen. Do not confuse that with the Andalucia code. If Airbnb or Booking asks for “licence number” in Andalucia, the practical answer is the RTA/VUT code, not the annulled national NRUA.

Ongoing obligations after registration

Registration is not the end of the compliance file. Four obligations matter most in 2026.

1. Guest data through SES.HOSPEDAJES

The Ministry of the Interior’s Hospedajes y alquiler de vehiculos pages say SES.HOSPEDAJES is the platform for registration-document and information duties under Real Decreto 933/2021. The Ministry’s scope page says lodging activity is covered whether professional or not, and its FAQ says private individuals are affected. Professional operators have registration, communication and conservation duties; non-professional operators still have communication duties.

2. Operating periods and declared capacity

After the 2024 Andalucia changes, tourist dwellings have to be coherent about operating periods, capacity and equipment. The safer file checks are capacity against cadastral surface, number of bedrooms, bathrooms, cooling/heating coverage, community approval and the exact months you intend to operate. A 15-person advertisement attached to a weak physical file is asking for trouble.

3. Community-of-owners approval

Decreto-ley 1/2025 added stronger housing and tourist-use controls. The current Junta FAQ asks for a certificate showing the community has expressly approved tourist use. For owners in apartment blocks, this is not a paperwork nicety. It is often the gate.

4. The 2026 sustainability declaration risk

The national annual NRUA declaration tied to the annulled register is no longer the live national-code issue. Separately, Andalucia’s sustainable-tourism law package is still moving. Until the final law is published and operational forms exist, treat sustainability reporting as a review trigger rather than something to improvise. The correct owner action is to keep the RTA file current now and review the page when the Junta law is finally enacted.

Enforcement reality in 2026

The wrong conclusion after the Supreme Court ruling is “the register was abolished, so enforcement is weaker.” The better conclusion is the opposite: the national register confusion has pushed the fight back toward the autonomous-community and municipal enforcement layers.

The Junta’s PIPA 2026 inspection plan is already published in BOJA. It includes a specific programme to detect clandestine tourist accommodation through systematic internet review, public clandestinity reports and inspection visits. It also says at least 30% of specific-programme actions should be reserved for detecting clandestinity in tourist dwellings and rural tourist accommodation.

Separately, lavozdelsur reported on 29 May 2026 that the Ministry of Housing asked the Junta to inspect, sanction and close more than 27,000 illegal tourist dwellings detected through the Property Registry in the year. That figure is politically contested, but for an owner it changes the risk calculation: platform data, registry data, RTA data and municipal controls are being compared more aggressively.

The proposed Ley de Turismo Sostenible sanction ladder is the other pressure point. Current reporting describes minor penalties rising to €10,000, serious cases from €10,000 to €100,000, and very serious illegal or clandestine cases up to €600,000. As of 8 June 2026, I did not verify the final enacted BOJA law text. The safe owner reading is still blunt: PIPA 2026 is live, the Junta has already cancelled thousands of tourist-use dwellings in recent enforcement activity, and the new sanctions law is the item to review the moment it is enacted.

Reclaiming your NRUA fee

If you paid a fee for the national NRUA process, do not just shrug and move on. idealista reported on 5 June 2026 on routes to recover fees after the register was declared null. The practical file is simple:

  • Keep the NRUA application receipt, payment proof and any registration or denial notice.
  • Keep platform messages showing listings were blocked, restricted or required the NRUA.
  • Keep agency or gestor invoices if you paid someone to handle the national register.
  • File a written administrative claim for the fee and any clearly evidenced costs you are claiming.
  • Separate the fee reclaim from your Andalucia RTA/VUT compliance file. One falling does not cancel the other.

This is a good Navigator task when the paperwork is scattered, the owner is abroad, or the property manager handled the original filing and nobody has the receipts in one place.

FAQ and edge cases

Do I still need a rental registration number in Andalucia?

Yes, if you are operating a tourist let that falls under Andalucia’s tourist-dwelling rules, you still need the regional RTA/VUT registration. What has fallen is the national NRUA registration procedure created by RD 1312/2024.

Is the Andalucia code VFT/MA or VUT/MA?

The old language was VFT, and many owners still know their code as VFT/MA/00000 in Malaga province. The Junta’s current FAQ now uses VUT examples. Treat VUT/MA/00000 as the current format to check against the RTA, while recognising that older documents and portals may still show VFT.

I never obtained the NRUA. Am I illegal now?

Not because of the annulled national NRUA alone. Your real exposure is whether the property has a valid Andalucia RTA/VUT registration, whether the code appears on listings, whether SES.HOSPEDAJES duties are being handled, and whether the town hall and community allow the tourist use.

What if I only rent occasionally?

The Junta FAQ says the declaration is required whenever the dwelling is rented habitually and for tourist purposes. It presumes habituality when the service is advertised, or when the service is provided one or more times in the same year for more than one month in total. It presumes tourist purpose when marketed on tourist-offer channels where booking can be managed.

Can the community of owners block my tourist let?

Yes, community restrictions and approval now matter heavily. The Junta FAQ asks for a community secretary or administrator certificate confirming express, current approval for tourist use. Before buying an investment flat, check the statutes and the current community position, not just the estate-agent listing.

Can a non-resident owner register a holiday let?

Yes, but the file usually needs more coordination: digital certificate or representative authority, correct tax and identification details, someone to handle guest-data duties, and a local operator or manager if the owner is not running the service directly.

Where should the code appear?

On every advertising or promotion surface: Airbnb, Booking, Vrbo, agency pages, social booking pages and your own direct-booking site. If a platform asks for a licence number after STS 620/2026, use the regional RTA/VUT code.

What should I review next?

Review three things before the next booking season: the RTA/VUT registration record, the code shown on every listing, and SES.HOSPEDAJES access. Then check again when the final Ley de Turismo Sostenible is enacted because the sanction language may move from proposed to live.
